DEFINITION

Period of hire
The total period of hire includes the time from which the equipment leaves the response base until it is returned to the same base or to a nominated port or airport if so agreed.

Response base
The response base means the oil spill response bases at Southampton, Singapore and Bahrain or at such other convenient location or locations in the United Kingdom, Singapore or elsewhere as may be determined by OSRL/EARL.

Daily In Use
The equipment daily in use charge shall apply for any period of time, (day or part thereof), that the equipment is deployed into response operations in the field, whether it is being used in oil or not, or is removed from a forward storage area. Any equipment returned from response operations back to the forward storage area shall revert to being subject to the daily standby charge.

Daily Standby
The equipment daily standby charge shall apply for any period of time, (day or part thereof), that equipment leaves the response base for the spill site, until it is returned to the response base, except for the time that the equipment is in use. This includes any period of time, (day or part thereof), that the equipment is held in a forward storage area awaiting deployment.

Length of working day
OSRL/EARL promotes safe working practices and must ensure the safety and welfare of its staff particularly when operating in the high levels of activity of an oil spill incident. The working day is therefore limited to 10 hours. Should extended
hours become a necessity it is a management responsibility to ensure that the appropriate number of staff are deployed to permit an effective shift system to be operated.


TERMS AND CONDITIONS

Rates
The rates contained in this Scale of Fees apply solely to oil spill response
incidents.

Quoted fees for oil spill computer modelling are based on the assumption that OSRL/EARL is provided with all the necessary maps and relevant information by the customer on a timely basis.

Rates for all other services are available on request.

Cap on hire charges
Hire charges will be capped at twice the replacement cost of the equipment. Once the capped value has been reached there may be an
option to purchase the equipment at replacement cost, the terms
for which will be agreed at the time. Rehabilitation, repair and maintenance costs will continue to be charged in the normal way, plus 15%.

Rehabilitation of equipment
Rehabilitation costs will be charged at 15% of the total “In Use” hire charge
for hire periods up to and including 4 days unless otherwise agreed in
advance. For hire periods in excess of 4 days rehabilitation costs will be
invoiced following completion of the rehabilitation and will include all costs incurred.

Consumables
All consumables will be charged at replacement cost. Non members will incur an additional 15% surcharge.

Aircraft charter
In the event that a chartered aircraft is required this can be organised
through a dedicated broker working. Invoicing for these costs will be
immediate. Payment from members is due within 15 days. Non members
may be required to pay in advance and will incur a 15% surcharge on all
invoiced costs.

Chemical Dispersant
Chemical dispersant which is not held in stock will be charged at purchase cost plus all procurement fees. Non members will be charged a fee of £2,000 for access to dispersant stocks and an additional 15% surcharge on all invoiced costs. The hire of dispersant in support of exploration and similar activities is only available to members.

Invoicing
Invoices will be issued on completion of the response or, in the case of a
response which exceeds one month in duration, invoices will be issued
monthly. Payment is due within 30 days of the date of receipt of the
invoice. Payments still outstanding after 30 days shall bear interest at
3% above base rate current from time to time during the period in question
until payment is received.
